Looking for help in your family court proceedings?Bridge The Gap is a free, community-built guide to UK family court, written by litigants and McKenzie Friends, for litigants. Real observations, plain English, and people who can help..
This content reflects observational insights and lived community experiences. It does not constitute legal advice — always consult a qualified professional for your specific circumstances.
A spouse who leaves and carries on paying the mortgage or household costs often treats that as settled. The spouse who stays may treat it as owed.
Without a court order, a pattern of payments between spouses is informal. Either person can change it, and it does not bind the other (see gaps 75 and 549). Financial claims between spouses stay open until a court order deals with them, however long the separation lasts (see gaps 425 and 559). Someone who needs temporary support during the divorce can apply to the court for maintenance pending the outcome of the proceedings, but the outcome is not guaranteed (see gap 41). Texts and emails about money after separation can have legal consequences (see gap 256).
Download the card and post it on Facebook, LinkedIn, or wherever you're active. Every share helps another litigant find this before their hearing.

Bridge The Gap
Without a court order, who pays what after you move out is informal. Either of you can change it.
If I move out and keep paying the same, is that agreed?
Reality
Not in law. A payment pattern between spouses can be changed by either of them. Financial claims stay open until a court order deals with them.
