What People Expect

Victims of domestic abuse sometimes assume there is no protection available and that engaging with proceedings means facing their abuser directly, including under cross-examination.

Court Reality

The Domestic Abuse Act 2021 gives eligibility for special measures, such as evidence from behind a screen or by video link, without needing to prove vulnerability. It also bans a perpetrator of domestic abuse from cross-examining their victim in person. Where questioning is still required, the court can appoint a qualified legal representative to conduct it instead. Both apply in private law children proceedings.
