What People Expect

A prenuptial agreement with poor or unclear drafting will be disregarded by the court and assets will be split equally instead.

Court Reality

In IC v AD [2026] EWFC 224, the judge called the prenup sub-optimal drafting and not a model of clarity and still enforced it. Following Radmacher v Granatino, prenups are given decisive weight unless unfair or failing to meet needs. Imperfect drafting does not automatically invalidate a prenup if both parties entered into it freely and understood its implications.
