The government launched a consultation in June 2026 proposing 'Qualifying Nuptial Agreements' that would be binding. But a consultation is not a law change. Prenups remain persuasive in England and Wales — the court considers them but is not bound by them. Until legislation is passed, your prenup does not guarantee the outcome.
