What People Expect

Many people expect a full hearing with live evidence and cross-examination in every case.

Court Reality

Courts can decide some matters on written evidence and submissions without oral evidence. Whether they do so depends on the case. Article 6 of the European Convention on Human Rights is relevant to fairness, but it does not mean every case must reach a full final hearing.
