Court Reality

Where domestic abuse has been proved, the judge must work through PD12J paragraphs 35 to 40, apply the welfare checklist in light of the findings, and explain why the order will not expose the child to harm. A decision based mainly on how a parent presented in court, without that analysis, can be overturned on appeal.
