Court Reality

In financial cases the court can order costs because of a party's conduct before or during proceedings (FPR r 28.3(6)). The court treats refusing openly to negotiate reasonably and responsibly as conduct it can take into account (PD 28A para 4.4). Silence can be presented as a refusal to engage.
