What People Expect

A parent, especially where the other parent is a foreign national or has ties to another country, sometimes believes that fear the other parent might leave the jurisdiction with the child is enough to justify restricting all international travel.

Court Reality

Courts look at whether the fear reflects a genuine flight risk or is really about a loss of control following abuse findings against the parent raising it. Where the family's actual life, home, and roots are in England, an international travel restriction can be seen as an unhelpful and unjustified point of ongoing dispute rather than real protection. Holidays abroad are generally treated as being in the child's best interests, and courts encourage parents to facilitate them rather than resist them.
