What People Expect

Someone who has already been covering the full mortgage payments alone since separating sometimes assumes this proves they can afford to take over the mortgage in their sole name.

Court Reality

Removing an ex-partner from a mortgage, or taking over sole ownership, requires a fresh affordability assessment against the lender's current criteria, as if applying from scratch. Lending rules may have tightened since the mortgage was first taken out, and being assessed on one income is different to being assessed on two, even where the payments have already been made alone for some time.
