What People Expect

Parents sometimes believe parental responsibility can be handed to another adult, such as a step-parent or new partner, informally or by a private arrangement.

Court Reality

Parental responsibility cannot be reassigned informally, not even to a step-parent. It can only be acquired through the routes set out in the Children Act 1989: a formal parental responsibility agreement (including a step-parent agreement under s.4A), a court order, or appointment as a guardian by a parent with parental responsibility, in a will or signed document, taking effect on that parent's death (s.5).
